I'm not sure I agree with all of your assessment. You're saying that requiring him to authorize the release of PHI or suffer the consequences, possibly wrongly, is not invasive? It certainly feels like a kind of extortion, at the least it is clearly coercive. In any case, the test results would still be considered PHI once the website has recieved it. After recieving PHI the website has a duty to follow HIPPA guidelines regarding storage and transmission of said PHI. My understanding is that by recieving the test results they assume liability for all possible HIPPA violations. Let me know if that's wrong, it could be. Another question I have is, if the information published by the site were false and he could prove damages, couldn't he have filed a legitimate libel suit?
